Who is the authority competent to extend area validity of arm license to other states/All India
Under Rule 19 (2), Arms Rule 2016, this office is empowered to grant Area Validity to the following category of licensees.
1. Union Ministers or Members of Parliament;
2. Persons of Defence Forces and Central Armed Police Forces;
3. Officers of the All India Services;
4. Officers in the Government or Government Sector Undertakings of Public Sector Undertakings with liability to serve anywhere in India;
5. Dedicated sports persons and the sports persons specified in serial numbers (1) to (4) of the table in rule 40 (2).
Except the above, under Rule 19 (3), all other cases are forwarded to the Office of L.G Delhi through Home Department, GNCT of Delhi for grant of area validity to other states or All India as the case may be.

Who will renew the extension of Area validity after the expiry of 3 years. Do I have to apply again after the expiry of the period of 3 years by submitting all the documents.
This office will renew the extension of area validity after its expiry. You are not required to submit the documents again. An application on plain paper will be sufficient provided your arm license is valid and requisite fees is paid.

In case of Govt./private service, service certificate issued by his supervisory officer/Employer/Head of Office (with name, Designation and complete office address) containing present posting, present address, permanent address and desirability report that the applicant needs extension of his Arms License in requisite/concerned state (with date of issue of serving certificate). Self attested copy of Date of Birth proof (e.g Matriculation certificate or School leaving Certificate, Passport etc.)
8. In case of business/property, the latest certified copies of ownership/occupancy (with name(s)relation(s) of owner(s) of property/business) regarding business premises/office/property in the requisite/concerned state(s) required under Law and Regulations including GST be provided. If the applicant has established office in the requisite state(s) then the applicant may attach all the requisite/authentic/genuine documents, issued by the concerned competent authority, in support of his submissions. 9. Proofs/copies of documents with date(s) regarding frequency/number of visits to the place(s)/concerned State(s) for which extension is sought including copies of fare tickets, petrol pump receipts, toll tax receipts etc. (with checklist/datewise list and Self Attested)
10. The proposed/shortest route journey and MAP by/through which the applicant travels to the proposed area of extension
11. If there is any threat perception, documentary proof be attach with full justification to carry weapon in the requisite/concerned State(s)/beyond the existing jurisdiction(Self Attested)
12. Undertaking to the effect that all the documents provided by the applicant are correct/genuine/authentic/latest and there is no anomaly in the documents furnished by him. In case of ambiguity in documents, his case may result in rejection
13. Financial status proof like income tax return (ITR)/salary slip.
14. Weapon handling certificate (not required in case of Armed Forces personnel, police and paramilitary forces).
15. All documents provided by you must be correct/genuine/authentic/latest and there should be no anomaly in the documents furnished by you. In case of ambiguity in documents, your case may result in rejection
16. The proof of any property in the requisite state(s) for which extension is sought, certified copies of the same be provided.
17. Justification to carry weapon beyond the existing jurisdiction, if there is any threat perception documentary proof be provided

Is extension of Area Validity has any fixed period?
Presently, the area validity is extended for a period of 5 years only.

Can area validity of the arm license for other states/All India, granted to me once be curtailed?
Yes, under proviso Rule 19 (4), the renewing authority on being satisfied on the basis of some material evidence that you do not require extension of area validity any more, may recommend for the review of your case.

FAQs in case of death of licensee
As a legal heir, what should I do to dispose off the weapon?
Here you have three options:
1. If any family member is already having an arm license, then this weapon can be added to his arm license with the approval of the licensing authority provided all legal heirs have given the consent in this regard. May kindly see the list of documents required.
2. If any family member do not have any arm license and wants to keep this weapon, then he/she should apply for a fresh arm license under inheritance category. May kindly see the procedure and list of documents required in this regard.
3. If all family members agree, then this weapon can be sold to any other licensee or authorised arms dealer. May kindly see the procedure for sale/transfer and documentation required for sale/transfer/gift of weapon.

I was having one of my family members as retainer in my license. But now at the time of renewal, the name of retainer has been removed. Why?
In the new Arms Rule 2016, the provision for having a person as retainer for the license of individual has been withdrawn. Now a new provision of Additional Licensee has been added. May kindly see the details under Additional Licensee.
However, the provision for retainer is still continuing for the companies under Rule 22 of the Arms Rules 2016.

Can a single arm license be made in the name of two family members and can any of them carry the weapon?
Yes. Concept of additional license is introduced in arms rules 2016 for close relatives i.e. Father, mother, son, daughter, brother and sister. An additional license maybe granted with same terms as parent license. For this purpose, the original licensee has to move an application to his licensing Authority enclosing the documents required for fresh arm license to be filled by the person to be added as additional licensee.

I want to get my name/surname changed in my arm license. What should I do?
You will have to apply online and fill the requisite form and submit the documents as per List . After processing your request, you will receive confirmation sms, to visit the Licensing Branch. Kindly bring original arm license and the original documents of those which were submitted by you online. I want to change my photograph on my arm license. What is the procedure?
You may simply visit our office on any working day. with a simple request on plain paper. Kindly bring original arm license booklet and two passport size photographs in white background. After payment of Rs. 500 as service charges, one photograph will be affixed and stamped on your arm license booklet and second photograph will be kept in record.

There is a spelling error in my name or other details. What should I do to get it corrected?
You may simply move an application on plain paper pointing out the discrepancy. If it is human error on part of the licensing authority, it will be corrected after verifying with the record.

Some incorrect details about the weapon or its number has been mentioned in my arm license. How it can be got corrected?
You may present your weapon for inspection alongwith original arm license and supporting documents, if any. The needful will be done after inspection of weapon and scrutiny of the record.

I have shifted my residence in new locality within Delhi. What should I do?
You should immediately inform the licensing Authority about the change of address. For this you will have to fill up the form online and submit proof of residence of the new address where you have shifted.
Your request will be forwarded to the local Police Station for verification. After the receipt of verification report, it will be processed in the office and you will be informed to visit the licensing Branch with the original Arm License booklet alongwith original proof of residence. The same will be entered into your arm license booklet and our record.

How many weapons are allowed to a person in India?
Under section 3 (2) of Arms Act, 1959, a person cannot have more than 2 arms in his possession. The exceptions are provided in sub section (3).

Can my application for arms license be rejected?
Yes. Please go through Rule 14 of Arms Rules 2016, in this regard. However, If your application for arms license is rejected, the Licensing Authority will pass a detailed speaking order and the copy of the same will be provided to you free of cost.

Can I appeal against the order of the Licensing Authority? If yes to whom.
Yes. Under Rule 18 of the Arms Rule 2016, you can make an appeal within a period of 30 days against the orders of the Licensing authority. Hon’ble L.G. is the Appellate Authority in Delhi.

What is the affect of any criminal case registered against me after an arm license has been issued to me.
If you fail to disclose the registration of criminal case against you within a reasonable time and it comes to the knowledge of the Licensing Authority, then it will be treated as a concealment of material information and may lead to suspension/revocation of the license.
Since as per Arms Rules, every renewal is to be treated as a fresh Arms application, the Licensing Authority may apply its own mind to decide your suitability to possess a fire-arm and may seek further clarification from you as well as from local police.

What are the implications of failure to renew the arm license within/before the expiry of its validity?
There are many. First, you will be deemed to possess a fire-arm without a valid license, which is a punishable offence under the Arms Act.
Secondly, as per Section 21 of Arms Act 1959, the licensee should immediately deposit such fire-arm with the police station or the arms dealer. Here again, failure to comply with this provision is also a punishable offence separately under Section 30 of the Arms Act, 1959.
Thirdly, if the Licensing Authority is not satisfied with the reasons for delay in renewal, it may suspend/revoke your license. So it is in your interest to never miss the validity date of your arm license.

What is the prescribed age for grant of an Arms License?
One should have attained the age of 21 years on date of making application for an Arms license. No, you are not eligible for grant of an arms license on heirloom basis. The transferor should either have attained the age of 70 years or license should have been issued to him 25 years, prior to making such application.

Who has to apply for Registration of license in Delhi?
A person holding an Arm License changes his pace of residence, permanently, or temporarily for a period of more than six months needs to apply to the New Licesning Authority for Registration of his Arm License. Thus, any arm license holder who is having valid arm license issued/last renewed by Licensing Authority of outside Delhi and
(1) has shifted Delhi from other state/union territory OR

You should mention your new address where you are actually residing and should enclose the documents of this address only. If it is confirmed on physical verification, then at the time of your renewal, your new address will be updated in the system after charging the prescribed fees.

I have got a license with All India Validity. Can I get it renewed from anywhere in India?
No. Area validity is only the authorization to carry the weapon in that particular area i.e. state or All India, even that is subject to particular state restrictions. But all the services on your license will be provided by the Licensing authority where it is registered. A license can be registered with one Licensing Authority at a time and that too where you are physically residing.

At the time of actual renewal, you may submit the proof of deposit. On being satisfied, your arm license will be renewed with the condition to produce weapon for inspection within 7 days. On the basis of this renewal, you may get the weapon released and produce the same in this office for inspection immediately. After inspection of weapon, your renewal will be done for the total period as per rules.

How many days in advance I can apply for renewal of arms license?
As per Rule 24 of Arms Rule 2016, the licensee can apply 60 days in advance prior to expiry of the license.

I could not apply for renewal in time. Is there any penalty charge for late renewal?
You can apply within 30 days of the date of expiry of the renewal. In that case, no late fees will be levied. Beyond that, late fees will be charged.

The renewal process can be completed through a person authorized by the licensee in writing but the Licensing Authority may require the personal attendance of the licensee at the time of renewal. Kindly see Rule 24 (6) in this regard.

At the time of renewal, I have been told that there are criminal involvements against my name whereas these are old cases and have also been decided.
In all likelihood, you did not inform this office about your criminal involvements or this office has no previous knowledge of these cases/proceedings. A report regarding present status of the cases/proceedings will be called from the concerned Police Station/office. Thereafter, the matter will be put up before Licensing Authority for decision. This will result in little delay in comparison to normal renewal cases.

If, it is correct, then most probably it is a case of wrong entry in the record/system. A report in this regard will be called from the concerned police station/office. After receiving the confirmation of no involvement, the renewal will be done.

I have shifted my residence outside Delhi and my license has expired. What should I do?
As per rules, you were duty bound to inform your new Licensing Authority about the shifting of your residence in its jurisdiction and get your arm license registered with it. However, you may apply online and submit an application stating these facts and submit proof of new address. Your request will be examined and Licensing Authority, on being satisfied, may renew your license for a short period to facilitate registration with new Licensing Authority.

What is the mode of payment of fees in renewal cases?
Your payment of fees will be calculated at the time of actual renewal and will be accepted at the fees counter through Credit/Debit card only.

My license has expired and the time limit granted to purchase the weapon has also expired. What should I do?
Always avoid such kind of situations as it slows down the processes and increases the paper formalities. In this case you will have to apply for ‘revalidation’ of your arm license. If you have not availed the 2+1 year of purchase period, then Licensing Authority may grant you the purchase period for the remaining time and may also renew your license.
Otherwise, the Licensing Authority may cancel your license and may direct you to apply for fresh arm license.

Proof of residence in case the applicant does not possess Aadhar Card or Passport - (election card, or electricity bill, or landline telephone bill, or rent deed or lease deed, or property ownership's documents or any other document to the satisfaction of the licensing authority)
Weapon(s) for inspection ( to be brought at the time of appointment.
Aadhar Card or in case the applicant does not have Aadhar Card, a written declaration to be submitted in the form of an Affidavit along with and alternative identification proof which may include - Passport, Voter Identification Card, PAN Card or Identity Card issued to the employees
Posting-cum-residence certificate / recommendation from the Commanding / supervisory Gazetted Officer is mandatory (In case of Armed Forces Personnel, and paramilitary forces only). Police personnel may also submit this proof. In that case 2nd proof of residence not required.
