If a Certificate of Registration is defaced, lost or destroyed, the Registering Authority may on an application made to him and after such enquiry as he may think fit, issue a duplicate copy of the Registration Certificate on payment.
REGISTRATION FEES:- The registration fee payable for every certificate of registration shall be Rs.300/-(Three Hundred Rupees) for whole validity period of 3 years subject to the validity of Municipal Health Trade License.
TRANSFER OF REGISTRATION CERTIFICATE/CHANGE OF ADDRESS OF R.C. HOLDER OR CHANGE OF NAME OF THE EATING HOUSE IN REGISTRATION CERTIFICATE. :
The Registration Certificate may be transferred in case of death of Registration Certificate holder or other circumstances after the production of amended Health Trade license issued by the civic body alongwith other required documents, after due Character Verification etc. as deemed fit by the Registering Authority. In case of change of address of Registration Certificate Holder, the same is amended subject to Character & antecedent verification of the applicant. The change in name of the Eating House is endorsed in the Registration Certificate after production of amended Trade License.
The Certificate of Registration is liable for cancellation by the Registering Authority for violation of any regulation or Directions issued by the Registering Authority after the holder of certificate of Registration has been afforded a reasonable opportunity of showing cause against such cancellation.
If the operation of the Eating House has been closed due to any reason, the R.C. holder may sumit a written request to the Registering Authority for cancellation of the R.C. by surrending the same.
POWER TO ISSUE DIRECTIONS:- The directions that may be issued from time to time by the Registering Authority for preservation of order in public places etc. shall be complied with by the holder of Registration Certificate.
No Show Cause Notice for cancellation of Registration Certificate, shall be issued without approval of the Registering Authority, Such notice issued under the signature of Assistant Commissioner of Police is served directly to the person concerned, and a copy is marked to the local Deputy Commissioner of Police. A period of 15 days to show cause including personal hearing is afforded from the date of receipt and the notice is decided expeditiously and in any case within a period of 60 days.
A person aggrieved by the orders of the Registering Authority may file an appeal before the Commissioner of Police, within a period of 30 days from the date of the order of refusal for grant/renewal of Registration Certificate is communicated to him.
As per the order of delegation of Power issued by the Commissioner of Police, Delhi vide No. 83-182/Spl.Cell/PHQ dated 01.02.08, the Addl. Commissioner of Police, Licensing, Delhi is the Registration Authority in relation to the registration of Eating Houses.
